Terms of Service

By accessing or using Noir Division ("the Service"), provided by Loopcode Bilişim Yazılım Mühendislik Eğitim ve Danışmanlık A.Ş. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

Noir Division is an AI-powered noir detective tabletop role-playing game (RPG) platform. It provides an AI Game Master that narrates interactive story campaigns, tools to create and manage characters, AI-generated character portraits and poses, solo and multiplayer play (including real-time text and voice chat), AI companions, an in-game item marketplace, and community features. The Service is available via web browser at noirdivision.com.

To use the Service, you must create an account by providing accurate, current, and complete information, or by signing in with a supported third-party provider such as Google. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• You must be at least 16 years old to create an account.
• You are responsible for keeping your password and account secure.
• You must notify us immediately of any unauthorized use of your account.
• You may not transfer your account to another person without our written consent.

Certain features of the Service require an active paid subscription, including creating your own campaigns, using AI companions, and generating character portraits and poses beyond the free allowance. By subscribing:

• You agree to pay all fees associated with your chosen plan.
• Subscriptions are billed on a recurring monthly basis and are priced in your local currency (for example, USD or TRY) as shown at checkout.
• Your subscription renews automatically each month using your saved payment method until you cancel it.
• You may cancel your subscription at any time; access continues until the end of the current billing period.
• Gift codes grant a period of subscription access and are non-refundable and non-transferable once redeemed.
• Payments are processed by our third-party payment provider (iyzico); your card details are handled by the provider and are not stored on our servers.
• We reserve the right to change pricing with 30 days' notice.

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to any part of the Service or to other users' accounts.
• Upload malicious code, viruses, or harmful content.
• Interfere with or disrupt the Service or its servers.
• Use the Service, its chat, or AI features to harass, abuse, threaten, or harm others, or to generate illegal, hateful, or infringing content.
• Exploit bugs, glitches, or unintended mechanics to gain an unfair advantage or disrupt other players' experience.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated tools to scrape or extract data from the Service.

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

The Service and its original content, features, and functionality are owned by Loopcode Bilişim Yazılım Mühendislik Eğitim ve Danışmanlık A.Ş. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of the characters, stories, and other content you create or upload to the Service. By creating or uploading content, you grant us a limited license to host, store, process, and display your content as necessary to provide the Service.

The Service uses artificial intelligence to generate story narration, character portraits, poses, and other content. You acknowledge that:

• AI outputs may not always be accurate, consistent, or appropriate, and are provided for entertainment purposes.
• You are responsible for reviewing AI-generated content and for how you use it.
• AI features may require an active subscription or draw from your account's usage allowance.
• We may update or change the underlying AI models, which could change output quality or style.

The Service may include virtual items, in-game currency (such as gold), and a marketplace for trading between players. You acknowledge that:

• Virtual items and in-game currency have no real-world monetary value and cannot be exchanged for cash.
• We may modify, remove, reset, or rebalance virtual items and game mechanics at any time.
• Trades between players are provided as-is, and we are not responsible for disputes between players.

To the maximum extent permitted by law, Loopcode Bilişim Yazılım Mühendislik Eğitim ve Danışmanlık A.Ş. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses resulting from your use of the Service.

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by the laws of the Republic of Turkey. Any disputes shall be resolved in the courts of Istanbul, Turkey.
